Administrative Procedures in West Virginia

The Administrative Law Division serves as both archives and official clearinghouse for agency rules, notices, orders, decisions and other procedural documents.  Through online information, subscriptions, copy services, and extensive  imaged historical files, the division assures timely public access to requirements and procedures of West Virginia state agencies and boards.

 

Administrative Law

The Administrative Law Division was established in the Secretary of State’s Office in 1982 by amendments to the Administrative Procedures Act.  A single source for public access to agency actions impacting citizens and businesses provides reliable information for decision making and the opportunity for public involvement.

Code of State Rules

The Code of State Rules, or CSR, is a compilation of the current rules in effect of all agencies, boards and commissions which are covered by the Administrative Procedures Act.  In addition to the current rules, new proposed rules, emergency rules and historical rules are available.

State Register

The State Register is a weekly publication which provides public notice of the status of rules as they move through the rulemaking process, giving citizens the opportunity to learn about the proposals and comment before the final rule is considered.  It also lists meeting notices, new orders and decisions, rulemaking deadlines and other information.

Meeting Notices

Agencies covered by the Administrative Procedures Act are required to file a notice of each meeting in time to allow for publication in the State Register at least five days before the meeting.  Current regular and emergency meeting notices are available and updated daily.  Information on the Open Meetings Act, along with interpretive information provided by the Attorney General's Office is also available for review.  New!!  File your meeting notices online at www.wvsos.com

Orders, Decisions and Opinions

Decisions of the State Employees Grievance Board, opinions of the WV Ethics Commission, and agency and executive orders are filed with the Administrative Law Division for public review.

Rule Making

Agencies propose administrative, procedural and legislative rules to put in effect the details of the broader policies spelled out in law by the Legislature.  In West Virginia, making rules often involves a lengthy process which begins following one legislative session and does not end until after the close of the next year's regular session.  A complete step guide to rule making, filing schedules, exemptions and forms are provided to assist agencies in this process.

Publications and Services

The Division publishes the Code of State Rules, Index and State Register.  Subscriptions to the 13-volume CSR and the weekly Register can be ordered online.  Copies of individual rules and other documents maintained by the division are also available.
